Terms and Conditions

 

Payment constitutes your acceptance of these Terms & Conditions (referred to as “Terms hereinafter) constitutes a legal, binding agreement between you (referred to as “Guest(s)” hereinafter), whether part of a group tour or private tour, and Mohamed Sayed, Tracey Ash, and Travel Part- nership Teams (referred to as “Tour Operator” hereinafter), and is an acknowledgement that all parties have read, understand, and agree to be bound by all Terms contained hereinafter. Acceptance of Terms supersedes any and all previous communications between the parties, whether written or oral, with respect to the same.

TERMS AND CONDITIONS

  1. Tour Operator Responsibilities 

    • Accommodations based upon double occupancy as indicated in the itinerary.
    • All sightseeing tours and entries as indicated in the itinerary.
    • Meals as indicated in the itinerary, including V, VG, GF, LF, and detox options.
    • Arrival and departure airport transfers from Habu Hotel & Ecolodge & The Luxor Boutique hotel, or other hotels

  2. Guest Responsibilities 

    • International and intra-Egypt airfare

    • All meals and snacks not covered by Tour Operator.

    • Beverages

    • Single room upgrades

    • Travel insurance

    • Items not specifically mentioned in the itinerary.

    • Gratuities/Tips (20% is standard)

    • Entry visa, USD 25.00, which may be purchased from bank windows before passport control at the airport.

    • The costs of any supplements or optional site visits not included in Tour Operator itinerary.

  3. Guest Behavior/Indemnification

    • Please be aware that Egypt is predominantly an Islamic country, and Guest(s) should be aware of culture and religious conservatism, local traditions, customs, and laws.

    • Guest(s) are expected to follow the laws of the country they are visiting, specific rules and protocols for cultural, religious, and/or historic sites, and take care to not offend other cultures or religious beliefs.

      - This is especially important during the holy month of Ramadan and/or if Guest(s) intend to visit religious areas.

  • Foreign national tourists and travelers are tracked by multiple government agen- cies upon entry into Egypt. Security agents and convoys are often deployed for groups.

  • Guest(s) are hereby advised to be aware of cultural conservatism regarding all public meditation and yoga. The use of ceremonial objects, musical, instruments, and/or ritual oils is expressly forbidden, and publicly entitled ceremonial displays, rituals, and/or other outward displays of Western spirituality destroy bridges of po- tential cultural healing and harmony.

  • Touching of antiquities, including all antiquities monuments and artifacts, is abso- lutely not permitted.

  • Plant medicines and other illegal drugs are forbidden. Egypt has a zero tolerance policy towards illegal drugs, with possession, use, and/or trafficking in illegal drugs being treated as serious offences which can, even for small amounts, lead to lengthy prison sentences, up to life imprisonment without the possibility of pa- role or pardon, and the death penalty for the most serious offences.

  • Public displays of affection are culturally rare and may be frowned upon. What is acceptable in Western-style tourist resorts may not be accepted in other areas. Additionally, Guest(s) are advised to not engage in or seek casual sexual encoun- ters as you may be identified as a problematic international who is breaking Islam- ic law and/or you may be targeted for business.

  • Although same-sex activity is not expressly criminalized in Egypt, LGBT+ individ- uals have been charged with debauchery and there is little public acceptance for LGBT+ relationships. Public displays of affection are likely to receive unwelcome attention, as are rainbow flags and apparel and may result in charges of de- bauchery.

  • Guest(s) are expect to arrive to any tour pick-up and/or departure point at the time set for activities. During the Tour, Tour Operator!s drivers are not obligated to wait for Guest(s) after the time set by the Tour Operator!s representative. Tours may

    proceed without Travelers who miss pickup and/or arrival and departure times at any point during the Tour, and the Tour Operator will not be held responsible or liable for any compensation, refund, and/or damages caused to Guest(s) as a result thereof.

  • While participating in a tour, Guest(s) are required to stay with the Tour Operator and/or all designated representatives at all times. Tour Operator is will not be li- able for any Guest(s) who opt(s) to separate from the tour, permanently or tem- porarily, and Guest(s) will be solely responsible for any costs, fees, injury, or harm they incur or may cause. All additional costs and any/all associated fees to recov- er Guest(s), “rescue fees”, will be fully and exclusively borne by Guest(s). Guest(s) hereby acknowledge and agree that the shall have no right to offset or deduct any such rescue or similar in nature costs or fees applicable to Guest(s) under these Terms from any missed/unused site or attraction costs.

  • Tour Operator reserves the right at any time and our discretion to terminate the travel arrangements with the Guest(s) and/or cease to deal with any party mem- ber(s) whose behavior, in the reasonable opinion of the Tour Operator or our Third

Party Suppliers, may cause danger, upset, disruption, or distress to anyone else or damage to property. In such a case, Guest(s) will be responsible for the cost of travel back to their home location and the Tour Operator shall not be liable for Guest’s potential losses and no refund shall be provided.

• Guest(s) agree to and shall indemnify and hold harmless the Tour Operator, and each of our officers, directors, employees, and agents (collectively "Tour Operat- or”), from any expenses, losses, liabilities, damages, judgments, settlements, and costs (collectively, "damages”) involved with or incurred by the Tour Operator (in- cluding, without limitation, reasonable attorneys!# fees and the advancement of same) with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from:

- Guest!s breach or violation, or threatened breach or violation, of these Terms AND

- any damage caused by Guest(s) while participating on the tour.

5. Intellectual Property

• During tours and retreats, Guest(s) will have access to unique material and con- tent created and owned by Tracey Ash/Tour Operator and/or other third parties. This content is protected and unauthorized use of content, including by not limited to taking, possessing, and sharing through any digital and non-digital means unauthorized videos, sound recordings, and photographs, may violate copyright, trademark, and other laws.

6. Photography

  • Guests must have permission from Tour Operator and/or other involved third par- ties before taking photographs and videos at cultural and religious sites.

  • Permits are required for professional photography or film equipment of any kind. This includes photography umbrellas, artificial outdoor lighting gear, and any equipment that occupies or blocks public roads.

  • It is forbidden to take or share photographs that may be perceived as damaging to the country’s image.

  • Photographing Egyptian citizens requires written consent. Taking pictures of Egyptian children is prohibited.

  • Photography of or near official military installations is strictly prohibited, including but not limited to the Suez Canal. Please be aware of sensitivities regarding pho- tographing embassies, government buildings, churches and other religious build- ings, and infrastructure. Foreign nationals have been arrested for photographing churches, electricity stations, train stations, and bridges.

  • If there is any doubt, please seek permission before taking photographs.

    7. Drones

    • The import, production, or use of unmanned aircraft systems (drones) is banned in Egypt unless you have prior authorization from the Egyptian Ministry of De- fense. Citizens who use, manufacture, or import drones without the appropriate authorisation will be punished by prison terms ranging from 1-7 years and/or fines ranging from EGP 5,000 - 50,000.

  1. Third Party Suppliers

    • Tour Operator makes arrangements with accommodation providers, coach com-

      panies, transfer operators, shore excursion operators, tour and local guides, activ- ity providers, and other independent parties ("Third Party Suppliers") to fulfill re- treat and tour itineraries. Third Party Suppliers may also engage the services of local operators and sub-contractors. We take great care in selecting Third Party Suppliers, but we do not supervise or control these suppliers and cannot be re- sponsible for their acts or omissions.

    • Tour Operator shall not be held responsible for any cancellations, delays, diver- sions, or substitution of equipment; loss or damage to baggage or property; injury, illness, or death; or any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the any act, omission, error or negli- gence whatsoever by air carriers, rail, coach & ship companies, hotels, trans- portation companies, other persons providing any of the services and accommo- dations to travelers, or any other person not a direct employee or under exclusive control of the Tour Operator. Tour Operator is not responsible for any criminal conduct by third parties.

  2. Limitation of Liability

    • You release and discharge the Tour Operator and its representatives from any and all liability arising from your participation in the tour including, but not limited to, actions, or inactions, of Tour Operator undertaken pursuant to these terms and conditions and including those caused or contributed to by third parties including suppliers to Tour Operator and other participants on the tour.

    • You agree that this release will be legally binding upon yourself, your heirs, suc- cessors, assigns, and legal representatives; it being your intention to fully assume all risk of travel and to release Tour Operator from any and all liabilities to the maximum permitted by law.

    • Any disputes between the Tour Operator and Guest(s) shall be settled by the Egyptian courts.

      10. Force Majeure:

    • To the extent permitted by applicable law, in the event of a Force Majeure Event (as defined below), Tour Operator shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, with- out liability of any kind.

    • Unless provided for in these Terms or under applicable law, Tour Operator as- sumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other condition outside Tour Operator’s re- sponsibility and / or control (Force Majeure Event), including without limitation:

  • -   Fire
  •  
  • -   Volcanic eruption
  • -  Landslides

  • -  Inclement weather

  • -  Environmental pollution or contamination

  • -  Earthquake

  • -  Low or high water levels

  • -  Flood

  • -  Water or power shortages or failures

  • -  Tropical storms or hurricanes

  • -  Riots or civil commissions or disturbances or any other acts of similar nature

  • -  Sabotage

  • -  Strikes of labor disruptions

  • -  Arrests

  • -  Restraint of rulers or peoples

  • -  Expropriations

  • -  Acts of terrorism

  • -  War

  • -  Insurrection

  • -  Quarantine restrictions

  • -  Government health advisories or warnings or alerts of any kind of nature, in-

    cluding, but not limited to, warnings or regulations due to an epidemic/pan-

    demic

  • -  Government seizures

  • -  Refusal or cancellation or suspension or delay of any government authority or

    any license, permit or authorization

  • -  Damages to its facilities or the travel supplier and its facilities

  • -  Or any other unforeseen circumstances or any other factors unforeseen by

    The Company, or the tour operator if applicable, that adversely affects or ham- pers its ability to fulfill any of its contractual conditions.

  • If the Tour Operator cancels or reschedules a trip departure due to a Force Ma- jeure Event, the cancellation and refund terms in this agreement shall apply.

  • Unless otherwise required by applicable law, The Company will not be responsi- ble for paying any costs or expenses Guest(s) may incur as a result of a delay or a cancellation due to a Force Majeure Event.
